TOWN OF BOARD OF TRUSTEES MEETING AGENDA TUESDAY, JANUARY 19, 2010 7:00 P.M. KEENESBURG TOWN MEETING HALL The Board of Trustees of the Town of Keenesburg met in regular session on Tuesday, January 19, 2010 at Keenesburg Town Hall located at 140 S. Main Street. Mayor Kipp called the meeting to order at 7:00 p.m. Pledge of Allegiance Roll Call: Board members present: Trustees Cindy Baumgartner, Steve Brandt, Wendi Tyler, Tony Dreher, and Richard Traxler, and Mayor Danny Kipp. Board members absent: Trustee Leroy Blackston. Others Present: Town Clerk, Debbie Chumley Mayor’s Address: None. Public Comments: None. Consent Agenda a. Approval of minutes 12/21/09 b. Approval of Bills/Financials: Motion was made by Trustee Tyler, seconded by Trustee Brandt to approve the consent agenda items; motion carried 6-0, Mayor Kipp, Trustees Baumgartner, Brandt, Tyler, Dreher, and Traxler voting yes. Old Business c. ORDINANCE 2010-01 Emergency Ordinance to Extend the Medical Marijuana Moratorium: Motion was made by Trustee Tyler, seconded by Trustee Dreher to adopt ORDINANCE 2010-01 to extend the medical marijuana moratorium through July 31, 2010; motion carried 6-0, Mayor Kipp, Trustees Baumgartner, Brandt, Tyler, Dreher, and Traxler voting yes. New Business d. RESOLUTION 2010-01 Designating posting places and the town’s legal publication: Mayor Kipp explained that the town would like to change its legal publication to the Greeley Tribune, feeling that more residents received this paper over the Fort Lupton Press, and the posting places to remain as they have in the past at the town hall, and post office. Motion was made by Trustee Baumgartner, seconded by Trustee Brandt to adopt RESOLUTION 2010-01 designating posting places and the town’s legal publication; motion carried 6-0, Mayor Kipp, Trustees Baumgartner, Brandt, Tyler, Dreher, and Traxler voting yes e. RESOLUTION 2010-02 To Designate Authority to Appoint Election Judges: Mayor Kipp explained that this resolution will designate authority to appoint election judges to the town clerk. Motion was made by Trustee Baumgartner, seconded by Trustee Tyler to adopt RESOLUTION 2010-02 to designate authority to appoint election judges to the town clerk; motion carried 6-0, Mayor Kipp, Trustees Baumgartner, Brandt, Tyler, Dreher, and Traxler voting yes Board Member Information: f. 1) Decmeber Well Flow Data 2) SE Weld County Economic Development Initiative Update: Although the Town of Keenesburg, and the Town of Lochbuie have both adopted the resolution in support of SE Weld County Economic Development Initiative, the Town of Hudson has not as of yet. This plan will be on hold until such time as the Town of Hudson determines whether they wish to participate or not. 3) Lost Creek Commons Update: A meeting was held with Fred Plocher, and Steve Stoltau, Denver East Group, regarding the progress on Lost Creek Commons punch list. The punch list has not yet been completed, however once the weather turns the plan is to move forward and complete the remaining work in phase I, and to request final acceptance from the town. 4) Weld County Referral USR-1734 Staff Reports Legal: None. Engineering: Mayor Kipp, Marc, and Jim Wright met with North Front Range Water Quality Planning Association on January 6, 2010. They reviewed the utility plan in detail and requested several changes mostly minor in nature. This report is to be completed by Jim to incorporate the changes and will be presented to NFRWQPA at their meeting on Thursday, February 25, 2010. Once approval is granted from NFRWQPA this plan will then go the state for their approval. Public Works: Cornell has been having problems with their mechanical wastewater treatment, and has been trucking effluent to the town’s lagoons. They are being billed at a rate of $11.25 per 1000 gallons, as was the rate that was stated in the proposed agreement that was never approved as Cornell went with another option. The first meeting for the water line was held on Monday, January 11, 2010; in attendance were school district personnel and the contractors that were awarded the bid. Ground should be breaking sometime this week. Board Member Comments: Mayor Kipp discussed the Sloan farm lease, he met with Sherry Sloan earlier this week, and was advised that the town may receive as much as $1100.00 from the farm activity on the property. There was discussion regarding the possible trade of land regarding several different scenarios of trades. Mayor Kipp advised that Marc Sirios is back to work after an injury in December. He is able to perform light duty at this time lifting no more than 20 pounds, his next doctor’s appointment is scheduled for Tuesday, January 26, 2010. Committee Reports Finance: Met Monday, January 11, 2010 Water/Waste Water: No meeting Parks : No Meeting. Streets: No Meeting. Others Present: Town Clerk, Debbie Chumley g. Liquor License Renewal—American Legion: Seeing no concerns from the Weld County Sherriff’s department a motion was made by Trustee Baumgartner, seconded by Trustee Tyler to approve the renewal of the liquor license for the American Legion; motion carried 6-0, Mayor Kipp, Trustees Baumgartner, Brandt, Tyler, Dreher, and Traxler voting yes Adjournment: Motion was made by Trustee Tyler, seconded by Trustee Brandt to adjourn the meeting; motion carried 6-0; Mayor Kipp, Trustees Baumgartner, Brandt, Tyler, Blackston, and Traxler voting yes.
