Call to Order

The Board of Trustees of the Town of Keenesburg met in a special session Wednesday, January 04, 2017 at Keenesburg Town Hall located at 140 South Main Street. Mayor Kipp called the meeting to order at 6:13 p.m.

Roll Call

Members Present: Mayor Danny Kipp, Trustees Steven Brandt, Wilbur Wafel, Sandra Beach, Marc Johns, Kenneth Gfeller and Wendi Tyler.

Others Present:  Toni Pearl, Town Clerk and Kathleen Kelly, Town Attorney.

New Business:

  1. RESOLUTION 2017-02 Approving an annexation agreement between the Town of Keenesburg and EWS for annexations Nos. 1-4

Kathleen stated that the original annexation petitioners Kaufman Brothers and Juliss A Pluss were not comfortable with the first agreement therefore EWS purchased the property to  make the agreement between them and the Town of Keenesburg. Legal recommended the agreement be approved and noted the only change was to the property owners.  Motion was made by Trustee Gfeller seconded by Trustee Tyler to adopt RESOLUTION 2017-02 approving an annexation agreement between the Town of Keenesburg and EWS for Annexations No. 1-4. A roll call vote was taken; Trustee Brandt yes, Trustee Wafel yes, Trustee Beach yes, Mayor Kipp yes, Trustee Johns abstained, Trustee Gfeller yes and Trustee Tyler yes. Motion carried 6-0.

 

  1. ORDINANCE 2016-24 an emergency ordinance annexing the EWS annexation No. 1

Kathleen stated the ordinances were brought back and were not effective until an executed agreement was received. Section three of the following ordinances contain a blank space to be filled in with a date to be certain this requirement is met. She recommended January 30, 2017. Motion was made by Trustee Beach seconded by Trustee Brandt to adopt ORDINANCE 2016-24 approving an emergency ordinance annexing the EWS annexation number 1 into the Town of Keenesburg, Colorado and requiring an executed annexation agreement be received by the landowner on or before January 30, 2017. A roll call vote was taken; Trustee Brandt yes, Trustee Wafel yes, Trustee Beach yes, Mayor Kipp yes, Trustee Johns abstained, Trustee Gfeller yes and Trustee Tyler yes. Motion carried 6-0.

 

  1. ORDINANCE 2016-25 an emergency ordinance annexing the EWS annexation No. 2

Motion was made by Trustee Beach seconded by Trustee Gfeller to adopt ORDINANCE 2016-25 approving an emergency ordinance annexing the EWS annexation number 2 to the Town of Keenesburg, Colorado and requiring an executed annexation agreement be received by the landowner on or before January 30, 2017. A roll call vote was taken; Trustee Brandt yes, Trustee Wafel yes, Trustee Beach yes, Mayor Kipp yes, Trustee Johns abstained, Trustee Gfeller yes and Trustee Tyler yes. Motion carried 6-0.

 

  1. ORDINANCE 2016-26 an emergency ordinance annexing the EWS annexation No. 3.

Motion was made by Trustee Beach seconded by Trustee Brandt to adopt ORDINANCE 2016-26 approving an emergency ordinance annexing the EWS annexation number 3 to the Town of Keenesburg, Colorado and requiring an executed annexation agreement be received by the landowner on or before January 30, 2017.A roll call vote was taken; Trustee Brandt yes, Trustee Wafel yes, Trustee Beach yes, Mayor Kipp yes, Trustee Johns abstained, Trustee Gfeller yes and Trustee Tyler yes. Motion carried 6-0.

 

  1. ORDINANCE 2016-27 an emergency ordinance annexing the EWS annexation No. 4

Motion was made by Trustee Beach seconded by Trustee Tyler to adopt ORDINANCE 2016-27 approving an emergency ordinance annexing the EWS annexation number 4 to the Town of Keenesburg, Colorado and requiring an executed annexation agreement be received by the landowner on or before January 30, 2017. A roll call vote was taken; Trustee Brandt yes, Trustee Wafel yes, Trustee Beach yes, Mayor Kipp yes, Trustee Johns abstained, Trustee Gfeller yes and Trustee Tyler yes. Motion carried 6-0.

 

Kathleen explained the ordinances were brought back as emergency ordinances to allow them to be effective immediately and to allow the property owners time to meet the required conditions.

 

  1. Reconsideration of ORDINANCE 2016-28 an emergency zoning property knowns as EWS annexation Heavy Industrial (HI)

Motion was made by Trustee Tyler seconded by Trustee Gfeller to reconsider ORDINANCE 2016-28 an ordinance zoning property annexed to the Town of Keenesburg and known as the EWS annexation numbers 1-4. A roll call vote was taken; Trustee Brandt yes, Trustee Wafel yes, Trustee Beach yes, Mayor Kipp yes, Trustee Johns abstained, Trustee Gfeller yes and Trustee Tyler yes. Motion carried 6-0. 

 

Motion was made by Trustee Beach seconded by Trustee Tyler to adopt ORDINANCE 2016-28 an emergency ordinance zoning property annexed to the Town of Keenesburg and known as the EWS annexation numbers 1-4. A roll call vote was taken; Trustee Brandt yes, Trustee Wafel yes, Trustee Beach yes, Mayor Kipp yes, Trustee Johns abstained, Trustee Gfeller yes and Trustee Tyler yes. Motion carried 6-0.

Motion was made by Trustee Tyler seconded by Trustee Beach to adjourn the meeting. Motion carried 7-0. Mayor Kipp, Trustees Brandt, Wafel, Beach, Johns, Gfeller and Tyler voting yes. The meeting adjourned at 6:26 p.m.
