ORDINANCE NO. 2014-08
AN EMERGENCY ORDINANCE TO DELETE EXEMPTIONS TO THE BUILDING PERMIT REQUIREMENT UNDER THE INTERNATIONAL RESIDENTIAL CODE.
WHEREAS, on July 20, 2009 by Ordinance No. 2009-07, the Board of Trustees adopted by reference and with amendments the 2006 Edition of the International Building Code (“IBC”) and International Residential Code (“IRC”); and
WHEREAS, among the amendments to the IBC and IRC, the Board exempted certain types of work from the building permit requirement; and
WHEREAS, in the aftermath of certain severe weather incidents that caused substantial damage to structures located within the Town, the Board reconsidered the public purposes to be served by requiring a building permit be obtained before certain types of work may commence within the Town and by adoption of Ordinance No. 2011-04 repealed some of the IBC building permit exemptions; and
WHEREAS, the Board finds that repealing these same exceptions under the IRC will further the Board’s purposes when adopting Ordinance No. 2011-04, and bring the provisions of the IRC in line with the IBC; and
WHEREAS, an emergency exists because it is in the best interest of the public health, welfare, peace and safety of the citizens of the Town to require building permits be obtained prior to repair of damaged structures located within the Town.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF KEENESBURG, COLORADO:
Section 1. Section 18-1-20(c) of the Keenesburg Municipal Code is hereby amended to delete subsection (3), with subsequent subsections to be renumbered.
Section 2. If any article, section, paragraph, sentence, clause, or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The Board of Trustees hereby declares that it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid.
Section 3. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
Section 4. The Board of Trustees herewith finds, determines, and declares that this ordinance is necessary to the immediate preservation of public property, health, welfare, peace, or safety. Pursuant to C.R.S. § 31-16-105 this ordinance shall be effective upon adoption.
